《天津市道路交通安全责任制规定》已于2021年12月3日经市人民政府第173次常务会议通过,现予公布,自2022年1月15日起施行。
The “Provisions of Tianjin Municipality on?Responsibility for Road Traffic Safety”,which were?adopted at the 173th?executive meeting of the municipal people’s government on ?December 3,2021, are?hereby promulgated and shall come into force as of January?15,2022.

第一章 总 ?则
Chapter 1 General Provisions
?
第一条 为了落实道路交通安全责任,预防和减少道路交通事故,保障人民群众的生命财产安全,根据《中华人民共和国道路交通安全法》《天津市道路交通安全若干规定》等有关法律法规,结合本市实际,制定本规定。
Article 1 These provisions are formulated in accordance with relevant laws and regulations such?as the "Road Traffic Safety Law of the People's Republic of China" and?"Several Provisions on Road Traffic Safety in Tianjin Municipality "?and in light of the actual conditions of this municipality, for purposes of implementing road traffic safety responsibilities, preventing, and reducing road traffic accidents, and protecting the safety of people's lives and property.

第二条 本市行政区域内道路交通安全责任的落实和监督管理适用本规定。
Article 2 These Provisions apply to the implementation, supervision, and administration of road traffic safety responsibilities within the administrative region of this Municipality.

第三条 本市按照政府统一领导、各部门协调联动、全社会共同参与的原则,坚持属地管理、分级负责,坚持谁主管谁负责、谁审批谁负责,坚持管行业必须管安全、管业务必须管安全、管生产经营必须管安全,坚持党政同责、一岗双责、齐抓共管、失职追责,实行道路交通安全责任制。
Article 3 This Municipality implements the road traffic safety responsibility system in accordance with the principle of unified leadership of the government, coordination and interaction of various departments, and participation of the whole society, persisting?in territorial management and hierarchical duty, insisting that whoever is in charge is responsible, whoever approves is responsible and?that we must regulate safety in all industries, in all businesses, and in production and operation,?adhering to the principle of the equal duty for the Communist party and government, two types of duties for one post, joint management, and accountability for dereliction of duty.

第四条 市和区人民政府应当加强对本行政区域内道路交通安全工作的领导。
市和区人民政府主要负责人为本行政区域道路交通安全工作第一责任人,政府分管道路交通安全工作的负责人为主要责任人,政府其他负责人对分管范围内的道路交通安全工作负领导责任。
Article 4 The municipal and district people's governments shall strengthen the leadership over the road traffic safety work within their respective administrative regions.
The main person in charge of the municipal and district people's governments shall be the first responsible person for the road traffic safety work in the administrative area, the person in charge of the road traffic safety work in the government shall be the main person in charge, and other people in charge of the government shall be responsible for the road traffic safety work within the scope of their duties.

第五条 公安机关是道路交通安全管理工作的主管机关。公安机关交通管理部门负责具体实施道路交通安全管理工作。
交通运输、应急、城市管理、规划资源、住房城乡建设、市场监管、工业和信息化、商务、农业农村、发展改革、财政、教育、卫生健康、文化和旅游、生态环境、气象、邮政管理、银行保险监管等部门应当在各自职责范围内负责有关的道路交通安全工作。
Article 5 The public security authority?is the competent authority?in charge of road traffic safety management. The traffic management department of the public security authority?is responsible for the specific implementation of road traffic safety management.
Departments such?as?transportation, emergency response, urban management, resources planning, housing and urban and rural construction, market supervision, industry and informatization, business, agriculture and rural areas, development and reform, finance, education, health, culture and tourism, ecological environment, meteorology, postal management and the banking and insurance supervision are responsible for the relevant road traffic safety work within the scope of their respective duties.

第六条 市和区人民政府有关部门应当落实道路交通安全监督管理责任,构建权责一致、分工负责、齐抓共管、综合治理的协调联动机制,保障道路交通安全。
Article 6 The relevant departments of the municipal and district people's governments shall implement the responsibilities of road traffic safety supervision and management and establish a coordination and linkage mechanism with consistent powers and responsibilities, division of responsibilities, joint management, and comprehensive governance to ensure road traffic safety.

第七条 机关、团体、企业事业单位及其他组织在内部管理或者生产经营中,应当依法落实道路交通安全主体责任。
机关、团体、企业事业单位及其他组织的法定代表人、主要负责人或者实际控制人是本单位道路交通安全责任人,对本单位道路交通安全全面负责。
Article 7 Organs, groups, enterprises, institutions, and other organizations shall fulfill their duties for road traffic safety in accordance with the law in their internal management or production and operation.
The legal representative, main person in charge or actual controller of an organ, group, enterprise, institution or other organization is the person responsible for the road traffic safety of the unit and is fully responsible for the road traffic safety of the unit.

第二章 政府职责
Chapter II Government Responsibilities
?
第八条 市和区人民政府应当统一领导、组织、协调本行政区域内道路交通安全工作,履行下列职责:
(一)将道路交通安全工作纳入国民经济和社会发展相关规划,与经济建设和社会发展同部署、同落实、同考核;
(二)健全道路交通安全工作协调机制,督促落实道路交通安全责任制;
(三)制定道路交通安全管理规划并组织实施,保障道路交通安全工作经费,促进道路交通安全工作与经济建设和社会发展相适应;
(四)加强道路交通安全宣传教育,加大宣传投入,督促履行宣传责任和义务,提高公众道路交通安全意识;
(五)统筹城乡公共交通发展,积极扶持发展农村公共交通,拓展延伸农村地区客运的覆盖范围,保障农村群众安全、便捷出行;
(六)制定改善农村道路交通安全状况的计划,督促落实农村公路建设养护管理责任,加大农村公路建设和养护力度;
(七)建立健全农村道路交通安全组织体系,督促落实农村道路交通安全监督管理责任,加强农村道路交通安全管控;
(八)定期组织开展道路交通安全检查,建立完善道路交通安全隐患排查治理制度,落实治理措施和治理资金;
(九)加强突发事件情况下道路交通安全应对能力建设和应急、抢险救援资金投入,组织落实道路交通事故预防措施,完善道路交通事故应急救援预案,建立健全联动救援机制,提高施救水平;
(十)法律、法规和规章规定的其他道路交通安全工作职责。
Article 8 The municipal and district people's governments shall lead, organize, and coordinate the road traffic safety work within their respective administrative regions in a unified manner, and perform the following duties:
(1) To incorporate road traffic safety work into relevant plans for national economic and social development, and deploy, implement, and evaluate it together with economic construction and social development.
(2) To improve the coordinating?mechanism for road traffic safety work and urge the implementation of the road traffic safety responsibility system.
(3) To formulate and organize the implementation of road traffic safety management plans, ensure the funds for road traffic safety work, and promote the adaptation of road traffic safety work to economic construction and social development.
(4) To strengthen publicity and education on road traffic safety, increase investments in publicity, urge the fulfillment of publicity responsibilities and obligations, and raise public awareness of road traffic safety.
(5) To coordinate the development of urban and rural public transport, actively support the development of rural public transport, expand, and extend the coverage of passenger transport in rural areas, and ensure the safe and convenient travel of rural people.
(6) To formulate plans for improving rural road traffic safety, supervise the implementation of rural road construction and maintenance management responsibilities, and increase rural road construction and maintenance.
(7) To establish and improve the rural road traffic safety organization system, urge the implementation of the responsibilities of rural road traffic safety supervision and management, and strengthen the management and control of rural road traffic safety.
(8) To regularly organize and carry out road traffic safety inspections, establish and improve the inspection and governance system for potential road traffic safety hazards, and guarantee governance measures and governance funds.
(9) To strengthen the construction of road traffic safety response capacity and the investment of emergency and rescue funds in case of emergencies, organize the implementation of road traffic accident prevention measures, improve road traffic accident emergency rescue plans, establish, and improve joint rescue mechanisms, and enhance rescue levels.
(10) Other road traffic safety work responsibilities stipulated by laws, regulations, and rules.

第九条 乡镇人民政府、街道办事处应当协助做好所辖区域内的下列道路交通安全工作:
(一)将道路交通安全工作纳入社会安全稳定总体工作,明确承担道路交通安全监管工作的机构和人员,加强道路交通安全管控;
(二)组织开展道路交通安全宣传教育和文明交通宣讲活动;
(三)加强道路交通设施的管理维护,排查报告道路交通安全隐患;
(四)加强农村交通安全管理站、交通安全劝导站(以下称两站)建设,组织农村交通安全管理员、交通安全劝导员(以下称两员)落实交通安全劝导职责。
Article 9 Township people's governments and sub-district offices shall assist in the following road traffic safety work within their jurisdictions:
(1) To incorporate road traffic safety work into the overall work of social security and stability, clarify the institutions and personnel responsible for road traffic safety supervision, and strengthen road traffic safety management and control.
(2) To organize and carry out road traffic safety publicity and education,?and propaganda?on civilized traffic.
(3) To strengthen the management and maintenance of road traffic facilities and investigate and report potential road traffic safety hazards.
(4) To strengthen the construction of rural traffic safety management stations and traffic safety persuasion stations (hereinafter referred to as the two stations) and organize rural traffic safety administrators and traffic safety persuasion officers (hereinafter referred to as the two officers) to perform the duties of traffic safety persuasion.

第十条 市和区人民政府设立的道路交通安全委员会,负责协调解决道路交通安全方面的重大问题,定期分析道路交通安全形势,督促下级人民政府和本级人民政府有关部门落实道路交通安全工作职责。
道路交通安全委员会下设办公室,设在同级公安机关交通管理部门,负责道路交通安全委员会的日常工作。
Article 10 The road traffic safety committees established by the municipal and district people's governments are?responsible for coordinating and solving major problems in road traffic safety, regularly analyzing the road traffic safety situation, and urging subordinate?governments?and the relevant departments of the people's governments at the same level to implement the duties of road traffic safety work.
An office shall be established under the Road Traffic Safety Commission, affiliated?to?the traffic management department of the public security organ at the same level, and is responsible for the daily work of the Road Traffic Safety Committee.

第三章 部门职责
Chapter III Departmental Responsibilities
?
第十一条 公安机关负责本市道路交通安全管理工作,履行下列职责:
(一)贯彻落实国家ibet国际平台,ibet国际集团道路交通安全工作方面的法律、法规、规章和政策,并组织实施;
(二)维护本市交通安全和交通秩序;
(三)对公安机关交通管理部门及其交通警察执行法律、法规和遵守纪律的情况依法进行监督。
Article 11 The public security agency?is?responsible for the management of road traffic safety in this municipality, and perform the following duties:
(1) To implement?and enforce?the laws, regulations, rules, and policies of China on road traffic safety.
(2) To maintain traffic safety and traffic order in this Municipality.
(3) To supervise the implementation of laws, regulations, and discipline by the traffic management department of the public security agency and its traffic police in accordance with the law.

第十二条 公安机关交通管理部门负责具体实施道路交通安全管理工作,履行下列职责:
(一)依法查处各类道路交通安全违法行为,对严重的道路交通安全违法行为开展专项整治,维护道路交通秩序;
(二)依法调查处理道路交通事故,并采取措施尽快恢复交通,分析事故发生原因,总结事故特点和规律,定期向本级人民政府报告并抄送相关部门;
(三)根据道路和交通流量的具体情况,依法采取疏导、限制通行、禁止通行等措施,遇有自然灾害、恶劣天气或者重大交通事故等严重影响道路交通安全的情形,依法实行交通管制;
(四)发现存在交通事故频发路段或者停车场、道路配套设施存在交通安全严重隐患,及时向本级人民政府报告并提出消除隐患、防范交通事故的建议;
(五)依法实施机动车登记和机动车驾驶证管理工作;
(六)加强道路交通安全宣传,及时向社会公众提供实时路况、交通拥堵信息,为社会提供交通信息引导服务;
(七)加强对农村两站、两员工作的指导,加大对农村地区道路交通安全违法行为的联合管控力度;
(八)加强与银行保险监管部门及保险机构的合作,提升道路交通协同共治水平;
(九)依法会同公用事业管理等部门在城市道路范围内施划停车泊位,向社会公布并适时动态调整;
(十)法律、法规和规章规定的其他道路交通安全工作职责。
Article 12 The traffic management department of the public security agency is?responsible for the specific implementation of road traffic safety management, and perform the following duties:
(1) To investigate and punish all kinds of acts?in violation of road traffic safety law, carry out special rectification for serious violation of road traffic safety law, and maintain?the?road traffic order.
(2) To investigate and handle road traffic accidents in accordance with the law, take measures to restore traffic as soon as possible, analyze the causes of accidents, summarize the characteristics and laws of accidents, and regularly report to the people's government at the same level and send copies to relevant departments.
(3) To take measures such as diverting, restricting passage, and prohibiting passage in accordance with the law and the specific conditions of roads and traffic flow, and in the event of natural disasters, bad weather or major traffic accidents that seriously affect road traffic safety, traffic control shall be implemented in accordance with the law.
(4) To report to the people's government at the same level in a timely manner and put forward suggestions for eliminating hidden dangers and preventing traffic accidents when discovering that there are road sections with frequent traffic accidents or serious hidden dangers to traffic safety in parking lots and road supporting facilities.
(5)?To implement motor vehicle registration and motor vehicle driving license management in accordance with the law.
(6) To strengthen the publicity?of road traffic safety, provide the public with real-time road conditions and traffic congestion information in a timely manner, and provide the society with traffic information guidance services.
(7) To strengthen the guidance for the work of the ‘two stations and two officers’?in rural areas and increase the joint management and control of road traffic safety violations in rural areas.
(8) To strengthen cooperation with banking and insurance regulatory authorities and insurance institutions to improve the level of road traffic coordination and co-governance.
(9)To plan parking spaces within the urban road range in accordance with the law, together with public utilities management and other departments, announce to the public and adjust dynamically in a timely manner.
(10) Other road traffic safety work responsibilities stipulated by laws, regulations, and rules.

第十三条 交通运输部门负责与道路交通安全有关的下列工作:
(一)依法加强道路运输企业安全监管,严格实施道路运输经营者、营运车辆及其驾驶人准入管理,督促道路运输企业落实道路交通安全责任;
(二)组织、协调超限超载治理工作,依法查处各类道路运输违法经营行为;
(三)依法实施公路养护和管理,完善公路安全防护设施,对临水临崖、连续下坡、急弯陡坡、交叉路口等事故易发路段按照规范标准设置公路交通安全设施;
(四)按职责分工做好高速公路全程监控等智能交通管理系统建设与管理维护等工作,配合支持高速公路交通安全执勤执法营房等配套设施建设;
(五)依法对道路运输企业动态监控工作进行监督考核,并将其纳入企业质量信誉考核的内容,作为道路运输企业班线招标和年度审验的重要依据,对违反道路运输车辆动态监督管理相关规定的行为实施处罚;
(六)加强对驾驶培训活动的监督,依法对驾驶培训学校、驾驶培训班实行备案管理;
(七)依法查处互联网租赁自行车经营企业未按照国家和本市有关规定投放车辆的违法行为。
Article 13 The transportation department is?responsible for the following work related to road traffic safety:
(1)?To strengthen the safety supervision over?road transport enterprises in accordance with the law, strictly implement the access management over?road transport operators, operating vehicles, and their drivers, and urge road transport enterprises to fulfill their road traffic safety responsibilities.
(2) To organize and coordinate over-limit and overload control work and investigate and punish all kinds of illegal operation relating to?road transportation in accordance with the law.
(3)?To?implement highway maintenance and management in accordance with the law, improve highway safety protection facilities, and set up highway traffic safety facilities in accordance with norms and standards for accident-prone sections such as waterfronts and cliffs, continuous downhill slopes, sharp bends and steep slopes, and intersections.
(4) To do a good job in the construction, management, and maintenance of the intelligent traffic management system such as the whole process monitoring of the expressway according to the division of responsibilities and cooperate with the construction of supporting facilities such as the law enforcement barracks for expressway traffic safety on duty.
(5) To supervise and assess the dynamic monitoring work of road transport enterprises in accordance with the law and incorporate it into the content of the assessment of enterprise quality and reputation as an important basis for road transport enterprise line bidding and annual verification and implement penalties for violations of the relevant regulations on the dynamic supervision and management of road transport vehicles.
(6) To strengthen the supervision of driving training activities and implement record-filing management over?driving training schools and driving training classes in accordance with the law.
(7) To investigate and punish the illegal acts of Internet rental bicycle business enterprises that fail to release vehicles in accordance with the relevant regulations of the state and this municipality.

第十四条 应急部门负责与道路交通安全有关的下列工作:
(一)按职责分工落实本市道路交通事故应急预案,协调有关专业应急救援队伍参与道路交通事故应急处置工作;
(二)依法组织指导道路运输生产安全事故的调查处理,监督事故查处和责任追究情况;
(三)会同公安机关交通管理等部门完善道路运输应急管理体系,构建快速救援机制,做好危险货物运输应急救援、处置等工作。
Article 14 The emergency department is?responsible for the following work related to road traffic safety:
(1) To implement the municipality's road traffic accident emergency plan according to the division of responsibilities and coordinate the relevant professional emergency rescue teams to participate in the emergency response to road traffic accidents.
(2) To organize and guide the investigation and handling of road transport production safety accidents in accordance with the law and supervise the investigation and handling of accidents and accountability.
(3) To cooperate with the traffic management departments of the public security agencies to improve the road transportation emergency management system, build a rapid rescue mechanism, and do well in the emergency rescue and disposal of dangerous goods transportation.

第十五条 城市管理部门负责与道路交通安全有关的下列工作:
(一)做好建筑垃圾综合管理工作,依法查处建筑垃圾运输车辆车体不洁、撒漏、不在规定地点装卸等违法行为;
(二)做好道路照明设施的维护、运行、监督管理工作;
(三)依法查处占用城市道路摆摊经营、乱堆放等行为;
(四)依法查处互联网租赁自行车经营企业未按照国家和???本市有关规定履行车辆停放管理责任,或者未及时清理违规停放、存在安全隐患、不能提供服务的互联网租赁自行车的违法行为。
Article 15 The municipality management department is?responsible for the following work related to road traffic safety:
(1) To do well in the comprehensive management of construction waste and investigate and punish illegal acts such as unclean bodies, spillage, loading and unloading at specified locations, etc. of vehicles transporting construction waste in accordance with the law.
(2) To do a good job in the maintenance, operation, supervision and management of road lighting facilities.
(3) To investigate and punish acts such as occupation of urban roads for stall operation, random stacking, etc.
(4) To investigate and punish Internet rental bicycle business enterprises in accordance with the law that fail to perform their vehicle parking management responsibilities in accordance with the relevant regulations of the state and this municipality or fail to promptly clean up illegal Internet rental bicycles that are parked in violation of regulations, have potential safety hazards, and cannot provide services.

第十六条 公用事业管理部门负责与道路交通安全有关的下列工作:
(一)城市道路桥梁、管线井等设施的监督管理;
(二)城市道路临时占用和挖掘管理;
(三)机动车停车场、道路停车泊位管理工作的统筹协调、监督检查及互联网租赁自行车停车秩序管理工作的监督指导;
(四)配合公安机关交通管理部门、交通运输部门依法查处超限超载货运车辆。
Article 16 The public utility management department is?responsible for the following work related to road traffic safety:
(1) Supervision and management of urban roads, bridges, pipeline wells and other facilities.
(2) Temporary occupation and excavation of urban roads.
(3) Overall coordination, supervision, and inspection of the management of motor vehicle parking lots and road parking spaces, and supervision and guidance of the order management of Internet rental bicycle parking.
(4) To cooperate with the traffic management department and the transportation department of the public security agency to investigate and deal with the overloaded freight vehicles in accordance with the law.

第十七条 规划资源部门应当在组织编制国土空间规划时,合理规划城市路网。
Article 17 The planning and resources department shall rationally plan the urban road network when organizing the preparation of national land and space planning.

第十八条 住房城乡建设部门负责政府投资的市政道路建设主体工程的设计、建设、验收管理工作,指导、监督建设单位落实交通安全设施与道路建设工程同步设计、同步施工、同步投入使用。
Article 18 The housing and urban-rural development department is?responsible for the design, construction, and acceptance check?of the main projects of municipal road construction invested by the government, and guide and supervise the construction units to implement the simultaneous design, simultaneous construction, and simultaneous use of traffic safety facilities and road construction projects.

第十九条 市场监管部门负责与道路交通安全有关的下列工作:
(一)加强对机动车安全技术检验机构的计量认证管理,对机动车安全技术检验设备进行检定,对执行国家机动车安全技术检验标准的情况进行监督,对机动车、电动自行车及其配件生产企业进行监督检查;
(二)依法查处生产、销售不符合安全技术标准的机动车、电动自行车,以及未取得强制性产品认证擅自出厂、销售、进口或者在其他经营活动中使用机动车、电动自行车的违法行为;
(三)依法处理在本市生产、销售未经国家机动车产品主管部门许可生产的机动车型的违法行为;
(四)对公安机关依法提请的与道路交通安全有关的检验、鉴定、认定等事项予以协助。
Article 19 The market supervision department is?responsible for the following work related to road traffic safety:
(1) To strengthen the metrological certification management over?motor vehicle safety technical inspection institutions, verify motor vehicle safety technical inspection equipment, supervise the implementation of national motor vehicle safety technical inspection standards, and supervise and inspect the manufacturers of motor vehicles, electric bicycles, and their accessories.
(2) To investigate and punish illegal acts of producing and selling motor vehicles and electric bicycles that do not meet the safety technical standards, as well as delivery, sale, import or use of motor vehicles and electric bicycles in other business activities without obtaining compulsory product certification.
(3) To deal with the illegal act of producing and selling motor vehicle models produced without the permission of the national motor vehicle product department in accordance with the law.
(4) To assist the public security agencies?upon request?in matters such as inspections, appraisals, and identifications related to road traffic safety.

第二十条 工业和信息化部门负责配合工业和信息化部实施本行政区域内道路机动车辆生产企业及产品准入和监督管理有关工作;配合市场监管部门依法处理在本市生产、销售未经国家机动车产品主管部门许可生产的机动车型的违法行为。
Article 20 The Department?of Industry and Information Technology is?responsible for cooperating with the Ministry of Industry and Information Technology in implementing the work related to the access, supervision and management over?road motor vehicle manufacturers and products within their respective administrative regions and is?responsible for cooperating with the market supervision department to deal with the illegal act of producing and selling motor vehicles in this municipality without the permission of the national motor vehicle product authority.

第二十一条 商务部门负责对报废机动车回收拆解企业实施监督管理,依法查处报废机动车回收拆解企业交易报废机动车整车、拼装车的行为,会同公安机关、市场监管等部门依法查处各类非法拆解活动。

第二十二条 农业农村部门负责与道路交通安全有关的下列工作:
(一)依法做好拖拉机登记、安全技术检验、驾驶证核发等工作,并向公安机关交通管理部门定期提供相关资料、数据;
(二)对拖拉机驾驶培训学校、驾驶培训班实行监督管理;
(三)健全完善上道路行驶拖拉机及其驾驶人信息共享机制,加强对拖拉机驾驶人的道路交通安全教育。
Article 22 The agricultural and rural department is?responsible for the following work related to road traffic safety:
(1) To do a good job in tractor registration, safety technical inspection, driving license issuance, etc. in accordance with the law, and regularly provide relevant information and data to the traffic management department of the public security agency.
(2) To supervise and manage tractor driving training schools and driving training courses.
(3) To improve the information sharing mechanism in relation to?tractors and their drivers on the road and strengthen road traffic safety education for tractor drivers.

第二十三条 发展改革部门应当将道路交通安全工作纳入国民经济和社会发展相关规划,综合平衡道路交通发展战略、规划和相关政策。
Article 23 The development and reform department shall incorporate road traffic safety work into the relevant plans for national economic and social development, and comprehensively balance the road traffic development strategies, plans and relevant policies.

第二十四条 财政部门负责建立道路交通安全长效投入机制,会同相关部门研究拓展道路交通安全资金来源政策,为道路交通安全工作提供经费保障;加强对道路交通事故社会救助基金筹集、使用、管理的指导和监督。

第三十二条 广播、电视、报刊、网络等媒体应当加强道路交通安全公益宣传,在重要版面、时段通过新闻报道、专题节目、公益广告等方式宣传道路交通安全法律、法规和规章以及道路交通安全知识,播报道路交通安全信息,曝光道路交通安全违法行为,发挥舆论引导和监督作用。

第三十三条 学校应当开展道路交通安全教育,依法建立健全校车安全管理制度,将学校自备或者租用接送学生的车辆纳入本单位安全责任制管理;配合公安机关交通管理部门做好上下学期间学校门口以及周边道路交通秩序管理工作。

第三十六条 机动车驾驶人培训机构应当严格遵守机动车驾驶人培训管理相关规定,建立健全业务管理、人员培训等管理制度;选用符合规定的驾驶人担任教练员,严格按照国务院交通主管部门规定的教学大纲,加强学员安全驾驶技能的培训。

第三十八条 机动车生产企业应当保证实际生产、销售车辆产品的有关技术参数、配置和性能指标,与国家道路机动车辆生产企业及产品公告批准的车辆产品、用于试验的车辆样品、产品合格证以及出厂车辆上传信息中的有关技术参数、配置和性能指标一致。
非机动车生产企业应当生产符合安全技术标准的非机动车。

第三十九条 机动车销售经营者应当销售符合国家安全技术标准的机动车或者经国家机动车产品主管部门许可生产的机动车型,不得销售报废、拼装或者擅自改装的机动车。
非机动车销售经营者应当销售符合安全技术标准的非机动车。
Article 39 Motor vehicle sales operators shall sell motor vehicles that meet the national safety technical standards or motor vehicle models produced under the license of the national motor vehicle product authority, and shall not sell scrapped, assembled or modified motor vehicles without authorization.

第四十条 机动车安全技术检验机构应当对登记后上道路行驶的机动车按照机动车国家安全技术标准进行安全技术检验,并出具检验结果。

第四十一条 机动车维修经营者应当按照备案的经营范围提供维修服务,不得擅自改装机动车,不得承修已报废的机动车,不得利用配件拼装机动车。

第四十二条 报废机动车回收企业应当取得报废机动车回收企业资质,严格按照国家有关规定从事报废机动车回收拆解活动。

第四十三条 机动车所有单位应当贯彻落实道路交通安全法律、法规、规章以及有关规定,履行下列道路交通安全责任:
(一)加强对本单位所属人员道路交通安全教育管理;
(二)制定本单位机动车使用、维修、保养、检查等管理制度,定期组织机动车安全检查,确保机动车安全性能良好;
(三)对本单位在道路交通安全检查中发现的隐患问题及时整改。
Article 43 Owners of motor vehicles shall abide by?road traffic safety laws, regulations, rules and relevant provisions, and perform?the following road traffic safety responsibilities:
(1)?To strengthen the management of road traffic safety education for the personnel of the unit.
(2)?To formulate the management system for the use, repair, maintenance and inspection of motor vehicles of the unit, and regularly organize motor vehicle safety inspection to?ensure that motor vehicles have good safety performance.
(3)?Timely rectify the hidden dangers found in the road traffic safety inspection of the unit.

第四十四条 道路旅客和货物运输企业等道路运输经营者除遵守本规定第四十三条的规定外,还应当履行下列道路交通安全责任:
(一)按照核定的经营范围从事道路运输经营活动,制定本单位道路交通安全管理制度,确定道路交通安全专职管理人员,加强车辆运输安全管理、营运场所秩序管理;
(二)制定道路交通安全目标和道路交通安全工作方案,建立考核评比制度和安全管理台账,定期组织开展安全检查,整改安全隐患;
(三)及时掌握本单位驾驶人身体和心理状况,对患有各类可能妨碍安全驾驶疾病或者有毒驾、酒驾等严重交通违法行为记录的驾驶人,不得安排其驾驶运输车辆。
道路旅客运输企业、道路危险货物运输企业和拥有50辆及以上重型载货汽车或者牵引车的道路货物运输企业应当建设道路运输车辆动态监控平台,或者使用符合条件的社会化卫星定位系统监控平台,对所属道路运输车辆和驾驶人运行过程进行实时监控和管理。
Article 44 In addition to complying with the provisions of Article 43 of these Provisions, road transport operators such as road passengers and cargo transport enterprises shall also perform the following road traffic safety responsibilities:
(1)?To engage in road transportation business activities in accordance with the approved business scope, formulate the road traffic safety management system of the unit, determine full-time road traffic safety management personnel, and strengthen vehicle transportation safety management and business site order management.
(2)?To formulate road traffic safety goals and road traffic safety work plans, establish an ?assessment and evaluation system and a safety management ledger, organize regular safety inspections, and rectify potential safety hazards.
(3)?To timely grasp the physical and psychological conditions of the drivers of the unit, and drivers who suffer from various diseases that may hinder safe driving or have records of serious traffic violations such as drug driving and drunk driving must?not be arranged to drive transport vehicles.
Road passenger transport enterprises, road dangerous goods transport enterprises, and road cargo transport enterprises with 50 or more heavy-duty trucks or tractors shall build a road transport vehicle dynamic monitoring platform, or use a qualified monitoring platform of socialized satellite positioning system to monitor and manage the operation process of their road transport vehicles and drivers in real time.

第四十五条 客运站经营者、货运站(场)经营者应当按照核定的经营范围从事经营活动,加强安全管理,完善安全生产条件,落实安全生产责任。
客运站经营者对出站车辆进行安全检查,严禁超载车辆或者未经安全检查的车辆出站。货运站(场)经营者不得为无道路运输经营许可证或者证照不全者提供服务,对出站车辆进行安全检查,防止超限、超载车辆或者未经安全检查的车辆出站。
Article 45 Operators of passenger stations and freight stations (yards) shall engage in business activities in accordance with the approved business scope, strengthen safety management, improve safety production conditions and implement safety production responsibilities.
The operator of the passenger station shall conduct safety inspections on the vehicles leaving the station, and it is strictly prohibit overloaded vehicles or vehicles without safety inspections to leave the station. Operators of freight stations (yards) shall not provide services for those who do not have road transport business licenses or have incomplete licenses, and conduct safety inspections on outbound vehicles to prevent over-limited, overloaded vehicles or vehicles without safety inspections to leave the station.

第四十六条 快递、即时配送等企业应当履行下列道路交通安全责任:
(一)建立健全本单位交通安全管理制度,明确安全责任人,定期对驾驶人开展道路交通安全法律、法规、规章的宣传、培训和考核;
(二)使用符合国家和本市标准的车辆从事配送服务;
(三)做好车辆和驾驶人的信息核查,并在与驾驶人签订的配送协议中明示驾驶人的交通安全义务及违约责任;
(四)督促驾驶人上道路行驶时,按照规定使用安全带、佩戴安全头盔,遵守道路交通安全法律、法规和规章;
(五)监督驾驶人按规定悬挂车辆号牌,做好车辆管理、维护等工作,确保车辆安全性能良好;
(六)根据交通状况等因素,合理确定配送时限、路线等标准和要求,避免引发道路交通违法行为或者交通事故。
Article 46 Enterprises such as express delivery and instant delivery shall perform the following road traffic safety responsibilities:
(1)?To establish and improve the traffic safety management system of the entity, clarify the person responsible for safety, and regularly carry out publicity, training and assessment of road traffic safety laws, regulations and rules for drivers.
(2)?To use vehicles that meet national and municipal standards for delivery services.
(3)?To check the information of the vehicle and the driver, and specify the driver's traffic safety obligations and liabilities for breach of contract in the distribution agreement signed with the driver.
(4)?To urge drivers to use safety belts, wear safety helmets?according to provisions, and abide by road traffic safety laws, regulations and rules when driving on the road.
(5)?To supervise drivers to hang vehicle license plates according to provisions, do a good job in vehicle management and maintenance, and ensure good vehicle safety performance.
(6)?According to the traffic conditions and other factors, reasonably determine the standards and requirements such as distribution time limit and route, so as to avoid causing road traffic violations or traffic accidents.

第四十七条 互联网租赁自行车经营企业应当按照国家和本市ibet国际平台,ibet国际集团总量调控和动态调整机制要求,有序投放和回收车辆;保持良好安全的车容车况,及时清理不能骑行的车辆,引导用户在规范设置的非机动车停放点停放车辆,并加强车辆停放管理。
遇有大型群众性活动、大范围施工等情况,互联网租赁自行车经营企业应当配合属地人民政府和交通运输、公安机关交通管理、公用事业管理等部门对互联网租赁自行车停放情况进行调整。
Article 47 Internet rental bicycle business enterprises shall place and recycle vehicles in an orderly manner in accordance with the requirements of the state and this municipality on the total amount control and dynamic adjustment mechanism. Maintain a good and safe vehicle appearance and condition, clean up vehicles that cannot be ridden in time, guide users to park their vehicles at the non-motor vehicle parking spots set in the norm, and strengthen the management of vehicle parking.
In the event of large-scale mass activities, large-scale construction, etc., the Internet rental bicycle business enterprise shall cooperate with the local people's government and the departments of transportation, public security authorities traffic management, public utility management to adjust the parking situation of Internet rental bicycles.

第五章 监督和责任落实

第四十八条 市和区人民政府应当建立健全道路交通安全工作考核评价体系,明确道路交通安全工作目标,并将其纳入监督检查重要内容,组织年度道路交通安全工作考核,考核结果作为主要负责人、分管负责人和直接责任人综合考核评价的重要依据。

第四十九条 市和区人民政府有关部门应当建立道路交通安全隐患日常管控机制,定期对道路交通安全责任落实情况进行检查,并对存在的突出问题进行督促整改。

第五十一条 市和区人民政府有关部门应当于每年12月31日前,向本级人民政府报告本部门履行道路交通安全工作职责情况。
区人民政府应当于每年1月5日前,向市人民政府报告上年度道路交通安全工作情况。
Article 51 The relevant departments of the municipal and district people's governments shall report to the people's government at the same level the performance of their duties of road traffic safety before December 31 each year.
The district people's government shall report to the municipal people's government the situation of road traffic safety in the previous year before January 5 each year.

第五十二条 市和区人民政府应当定期通报本行政区域内道路交通安全工作情况,存在以下情形之一的,由上级人民政府对下级人民政府主要负责人、本级人民政府对所属部门主要负责人进行约谈,要求其采取措施及时整改:
(一)1年内发生2起死亡3人以上道路交通事故或者发生性质严重、造成较大社会影响的道路交通事故的;
(二)未及时整改重大道路交通安全隐患的;
(三)年度道路交通安全工作考核结果为不合格的;
(四)与道路交通安全有关的其他需要约谈的事项。

(2)?Failure to rectify major road traffic safety hazards in a timely manner.
(3)?The result of the annual road traffic safety work assessment is unqualified.
(4)?Other matters to be interviewed related to road traffic safety.

第五十三条 本市建立道路交通事故领导干部赶赴现场机制。发生死亡3人以上道路交通事故或者发生性质严重、造成较大社会影响的道路交通事故的,事故发生地乡镇人民政府或者街道办事处、区人民政府及其有关部门、市人民政府及其有关部门的负责人应当在接到报告后立即赶赴现场,组织开展应急救援、善后处置等工作。

第五十四条 道路交通事故调查处理按照道路交通事故处理程序相关规定执行,其中属于道路运输生产安全事故的,还应当按照生产安全事故调查处理相关规定执行。
发生一般道路运输生产安全事故、较大道路运输生产安全事故的,由事故发生地的区人民政府负责调查;发生重大道路运输生产安全事故的,由市人民政府负责调查;发生特别重大道路运输生产安全事故的,按照国家有关规定调查。
市和区人民政府可以直接组织事故调查组进行调查,也可以授权或者委托有关部门组织事故调查组进行调查。
事故调查组由有关人民政府和公安机关、交通运输部门、应急部门等派员组成。
Article 54 The investigation and handling of road traffic accidents shall be carried out in accordance with the relevant provisions of the road traffic accident handling procedures, and if it is a road transport production safety accident, it shall also be carried out in accordance with the relevant provisions on the investigation and handling of production safety accidents.

Municipal and district people's governments may directly organize accident investigation teams to conduct investigations, or may authorize or entrust relevant departments to organize accident investigation teams to conduct investigations.
The accident investigation team is composed of personnel dispatched by the relevant people's governments, public security authorities, transportation departments, and emergency departments.

第五十五条 道路运输生产安全事故发生单位应当认真吸取事故教训,落实防范和整改措施,防止事故再次发生。
政府有关部门应当对道路运输生产安全事故发生单位落实防范和整改措施的情况进行监督检查。

第五十六条 各级人民政府和有关部门及其工作人员不依法履行职责,在涉及行政审批、道路以及交通设施建设、隐患排查整改、交通事故调查等方面工作不力、失职渎职的,依法追究有关人员的责任。

第五十七条 因不履行道路交通安全责任发生道路运输生产安全事故的,依法追究事故发生单位及其法定代表人、主要负责人或者实际控制人等相关人员的责任。

第六章 附?则

第五十八条 本规定中所称道路运输生产安全事故,是指《道路交通管理机动车类型》(GA 802-2019)中明确的生产经营性车辆在从事相应运输活动中发生人员伤亡的生产安全事故。
Article 58?The term “road transportation production safety accidents”?as mentioned in these provisions refers to production safety accidents in which the production and business vehicles specified in the “Road Traffic Management Motor Vehicle Types”?(GA 802-2019) cause casualties in the corresponding transportation activities.

第五十九条 本规定自2022年1月15日起施行。天津市人民政府2011年1月5日公布的《天津市道路交通安全防范责任制规定》(2011年天津市人民政府令第32号)同时废止。
